Terms and Conditions

1. Introduction

By engaging with Amalia Architects, you agree to be bound by these Terms and Conditions. These terms govern the architectural services provided to you, including consultation, design, and any other related services.

2. Scope of Services

The services to be provided by Amalia Architects will be outlined in the agreement or proposal. The services may include, but are not limited to, architectural design, project management, consultation, and coordination of permits. Any services outside the scope of the initial agreement may incur additional charges.

3. Client Obligations

  • The client agrees to provide the Company with accurate and sufficient information regarding the project requirements.
  • The client shall ensure the timely approval of designs and necessary decisions to avoid project delays.
  • The client is responsible for obtaining or assisting the Company in obtaining any necessary permits or approvals from local authorities.

4. Fees and Payment

  • The fees for services will be specified in the agreement. The Company will invoice the client based on the agreed-upon schedule, and payments must be made promptly.
  • If payments are delayed, the Company reserves the right to charge additional fees for late payments or suspend services until payment is received.

5. Confidentiality

Amalia Architects agrees to maintain the confidentiality of any confidential information shared by the client and not to disclose any information unless required by law or with the client’s consent.

6. Intellectual Property

  • All designs, drawings, concepts, and other intellectual property created by Amalia Architects for the project remain the property of the Company.
  • The client is granted a limited, non-transferable license to use the designs for the specific project, provided that all payments due to the Company are made in full.

7. Liability

  • The Company will perform its services with reasonable skill and care but does not guarantee specific outcomes or results.
  • Amalia Architects is not liable for any delays or damages arising from factors beyond its control, such as weather, labor disputes, or government regulations.
  • The client is responsible for ensuring that the final design complies with applicable local codes and regulations.

8. Termination

  • Either party may terminate the agreement by providing written notice. Upon termination by the client, any unpaid fees for work completed up to the point of termination will become due immediately. The client will not be entitled to a refund for work completed.
  • If the Company terminates the agreement, the client will be entitled to a refund for services not rendered.

9. Dispute Resolution

In case of a dispute, both parties agree to attempt to resolve the issue amicably through discussion. If a resolution cannot be achieved, the dispute may be submitted to arbitration in accordance with the laws of Kenya.

10. Governing Law

These Terms and Conditions are governed by the laws of Kenya, and any legal disputes will be resolved in the courts located in Kenya.

11. Amendments

Amalia Architects reserves the right to amend these Terms and Conditions at any time. Clients will be notified of any changes, and continued use of the Company's services constitutes acceptance of those changes.
